Abstract

The present study, without triyng to exhaust the subject, has as purpose addressing issues related to presente the notions of domestic and international arbitration under the problem of insufficient financial resources that can be configured at the time of the institution of the Arbitral Tribunal. Indeed, several solutions are found in foreign State Courts on this matter and will be pointed out, as well as the recent figure of the third-party funder (TPF) and the issues that permeate the subject.
